Circuit Court: Order Quashing Subpoena

The State has charged Bosque with three counts: Kidnapping, Tampering with a Witness, and Battery. In August 2011, Bosque was a Sergeant with the Opa-locka Police Department. The State alleges that Bosque was at the scene of a domestic disturbance involving Corey Davis.

THIS CAUSE came before the Court on a Motion to Quash Subpoenas (“Motion”) filed by Halifax Media Holdings, LLC d/b/a the Sarasota Herald-Tribune and its reporters Dan Wagner, 1 Matthew Doig and Anthony Cormier (the “Reporters”) (collectively referred to the “Herald-Tribune”). The Herald-Tribune moves this Court to quash three subpoenas (the “Subpoenas”) issued to the Reporters by the State of Florida (“State”) to testify at the June 16, 2014 trial of Defendant, German Bosque (“Bosque”). The Court has reviewed the Motion and case law provided by the parties, held an evidentiary hearing, heard argument of the parties, and is fully advised in the premises. The Motion is granted; the Subpoenas are quashed
